Perhaps the most contentious aspect of the proposed legislation is the thin line between algorithmic regulation and censorship. Michael Davis, a researcher at the University of Technology Sydney, points out that the draft's focus on "harmful content" could inadvertently incentivize platforms to engage in aggressive content removal. Davis argues that if platforms are held legally responsible for the *outcome* of their algorithms, they may opt for the simplest path to compliance: deleting content and banning users, rather than fixing the underlying systemic design of the recommendation engine.

As Australia navigates this regulatory frontier, the consensus among experts is that the law must remain flexible. Since algorithmic technology evolves at a pace that far exceeds legislative cycles, static rules may quickly become obsolete.
