The executive order, which leverages Section 232 of the Trade Expansion Act, is scheduled to take effect on December 4.
### Establishing Price Floors to Combat Dumping
Beyond the imposition of tariffs, the Trump administration is introducing a rigorous system of minimum import prices. This mechanism is designed to eliminate the viability of "dumping"—a practice where foreign entities sell goods below market value to drive out local competition. Under the new regulations, raw polysilicon will have a minimum import price of $21 per kilogram. The thresholds are higher for more processed materials: polysilicon ingots and wafers are set at $100 per kilogram, while finished solar cells and modules are priced at 22 cents and 38 cents per watt, respectively.
According to the White House, these measures are intended to create a more equitable competitive landscape for American producers. Since 2022, the United States has largely ceased importing polysilicon from China due to the Uyghur Forced Labor Prevention Act (UFLPA), which bans products sourced from the Xinjiang region—the global hub of silicon production.
Consequently, the financial burden of these new tariffs is likely to fall on US allies. Exporters from Germany and South Korea, who have stepped in to fill the void left by Chinese exports, may find their products suddenly more expensive. Furthermore, US-based solar panel assemblers, who rely on imported materials to build their modules, may face rising operational costs.
Critically, some experts argue that these protectionist measures ignore the root cause of China's dominance. They suggest that China's lead is not merely a result of subsidies, but a product of massive economies of scale driven by consistent market demand.
